Welcome to Writhm! These Terms of Service (“Terms”) govern your access to and use of the Writhm website and application (the “Service”). By accessing or using Writhm, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Use of the Service

You must be at least 18 years old to use Writhm. By using the Service, you represent that you are of legal age and have the authority to enter into these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms.

2. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or misleading, or if you violate these Terms.

3. Subscriptions and Payments

Writhm offers both Free and Pro tiers. Pro features are accessible via a paid subscription. All fees are in USD and are non-refundable except as required by law.

You may cancel your subscription at any time, but you will continue to have access to Pro features until the end of your billing cycle.

4. User Content

You retain ownership of any text, files, images, or other content you submit through the Service (“User Content”). By entering or uploading User Content, you grant Writhm permission to store, process, and display your content solely for the purpose of providing the Service.

You are solely responsible for your User Content and agree not to upload anything unlawful, harmful, or infringing.

5. Intellectual Property

Writhm respects your ownership and creativity. You retain full and exclusive ownership of all content you create using Writhm, including but not limited to text, drafts, revisions, and completed works (“Your Writing”). We do not claim any rights to Your Writing, and we will never use, share, publish, or distribute it without your explicit permission.

Your Writing is private by default. It is not used for training any AI models, and it is never shared with third parties.

All other content and functionality provided by Writhm—such as the software, user interface, and branding—is owned by Writhm or its licensors and is protected by applicable intellectual property laws. Using Writhm does not grant you any rights to our software or trademarks, and using Writhm does not grant us any rights to your work. You may not reproduce, distribute, or create derivative works from the Service without our express written permission.

6. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms. Upon termination, all rights granted to you will immediately cease.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, secure, or uninterrupted.

We are not liable for any loss of data, damages, or inconvenience caused by use of the Service.

8. Limitation of Liability

To the fullest extent permitted by law, Writhm shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the Service. Continued use after such changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
